Evaluator
Dispute Policy
Evaluator draws on this Dispute Policy to provide a solution for disputes that may arise between users on the website.
A company listed on Evaluator (hereinafter referred to as the ‘Reviewed’) considers a review, comment or other content (hereinafter referred to as the ‘Review’) of a user (hereinafter the ‘Reviewer’) to be in violation of the Review Guidelines and/or the General Terms and Conditions.
Key principles
Evaluator is an independent platform that facilitates communication between users on the one hand and other users/companies on the other. The reviews, comments and suggestions for improvement are not moderated by Evaluator. Evaluator relies on the honesty and integrity of the reviewers and the reviewed. In principle, the user community has been afforded the opportunity of self-regulation. The majority of opinions determines the overtone. False or inaccurate reviews or other undesirable content will generally be detected by the majority. This is the power of openness and the weight of numbers.
Nevertheless, Evaluator is able to take measures under its General Terms and Conditions to ensure that the rules, values and standards applicable to Evaluator are maintained. Such measures may include the removal of reviews that violate the General Terms and Conditions and the Review Guidelines
Notification of illegitimate reviews
Following registration on the website, Evaluator allows every reviewer and the reviewed to respond to reviews. The reviewed are encouraged to use this functionality to resolve differences of opinion, to improve customer communication or to thank customers. This is what Evaluator is designed for. Evaluator strives to encourage the reviewed to respond openly to received reviews about their services and products by always providing a comment.
Evaluator considers it important to hear both sides. If the reviewed or other users believe that a review violates our Review Guidelines and/or the General Terms and Conditions and would like to escalate the matter, they can do so by sending an official email to Evaluator at support@12build.com.
The notification must contain the following details:
- the date of and referral to the specific review;
- a motivated explanation as to why the review violates the General Terms and Conditions and/or the Review Guidelines;
- a description of the action that Evaluator should take according to the notifier with regard to the review.
After receiving the notification, Evaluator will investigate the notification and let the notifier know as soon as possible whether the notification will be dealt with further. If Evaluator decides to deal with the notification further, the utmost effort will be made to:
- suspend the review or comment in question;
- send the reviewer a copy of the notification with the request to respond to its content within 21 days.
Should Evaluator not receive a response from the reviewer in question within 21 days, the review will be permanently concealed or removed. Once Evaluator has received a timely response, a decision will be made within 21 days as to whether the review will be permanently concealed or removed, or whether it will be suspended pending investigation. The notifier and the reviewer will be informed as soon as possible after Evaluator has made a decision.
